Our client, a well-established coach company, faced an alarming situation: a trusted member of their management team had effectively taken control of the business by transferring £750,000 worth of assets into his own name.

These assets, which included essential bus contracts and vehicles, were critical to the company’s operations. Although our clients could prove they had funded the business and acquired the assets, they had no formal ownership claims, as everything had been placed in the manager’s name. This left them in a precarious position without legal grounds to recover their property through traditional means.

The Challenge

The key obstacle was the lack of formal legal ownership, which meant that taking the case to court would likely be unfruitful. Our client needed an alternative solution that would compel the individual to negotiate and return control of the assets.

They approached us with evidence of their financial investments, communications, and operational control over the business. However, with no direct legal recourse, we needed a strategic, unconventional solution to bring this individual to the negotiating table.

Our Approach

To devise a practical solution, we began by analysing all available documentation provided by our clients, including a lease agreement for the bus garage where the company’s vehicles and operations were based. We conducted surveillance on the facility, monitoring activity patterns, personnel movements, and business operations to understand the logistics of the site.

From this, we developed a tactical plan involving a lease forfeiture of the bus garage, aiming to disrupt the business and force a renegotiation. Using a team of highly trained ex-military professionals, we executed the operation in the early hours of the morning. This involved legally enforcing the lease forfeiture by securing and locking down the facility, effectively halting all business operations.
